Attorneys of Aysel Tuğluk: She must be released immediately 2022-08-06 13:05:03   DİYARBAKIR -  HDP Law Commission called for the release and treatment of ill prisoner Aysel Tuğluk , who was released in the Kobanê Case while she will remain imprisoned from another case.   Peoples' Democratic Party (HDP) Law Commission and the lawyer of Kurdish politician Aysel Tuğluk, Serdar Çelebi, held a press conference at HDP Diyarbakır Provincial Organization regarding the release decision of Tuğluk in the Kobanê Case. HDP Co-Chair of the Law and Human Rights Commission, Serhat Eren, said that Tuğluk has been in detention since December 2016 and has been struggling with dementia for a long time, which progressed in prison. Stating that Tugluk's examinations at Kocaeli State Hospital and ATK Specialized Departments began at regular intervals after the Seka State Hospital made a diagnosis in February 2021, Eren said: Despite all the applications made so far and the documents showing the critical stage of her health, she has not been released from the file where she is both imprisoned and convicted.   DECISION OF RELEASE   Stating that the court decided her release in the Kobanê Case, at the 15th hearing, Eren said: "There are many reports, prescriptions, scientific opinions of the Turkish Human's Rights Foundation, statement of other prisoners living with her and scientific data that shows she can not maintain her life alone in prison and they were all ignored." Pointing out that a release decision has been made in Kobané Case because she made her defense, Eren said: "Tuğluk was not released from the file she is convicted for.  In order for her to be released, the ATK must report that she cannot survive on her own in prison and the prosecutor must decide stay of the execution based on this report. As all the sensitive public is following closely, we are living in a period that distances not only from conscience but also from law and ethics in the person of Mr. Tuğluk and all other sick political prisoners. The coffins that got out of prison lately shows that the conscience mentioned in the interim decision is no longer there."   DEMAND FOR RELEASE   Stating that all applications made for Tuğluk's release or for a decision of stay of execution was rejected on grounds of Forensic Medicine Institude (ATK) reports, Eren said: "All other reports show that Ms. Tuğluk must be released."   DECISION FOR ÇEVİK BİR   Reminding that Çevik Bir, who was sentenced to life imprisonment in the 28 February trial, was released due to dementia, Eren said: "The two opposing verdicts given due to the same illness are also an indication of the unlawful and discriminatory approach shown to the Kurds and the political base represented by Tuğluk.   CALL FOR TUĞLUK'S RELEASE   Calling for Tuğluk to be released as soon as possible and to be treated in healthy conditions, Eren said, "We call the government, judiciary and ATK to abandon their discriminatory attitude, and we invite legal and non-governmental organizations, especially women's organizations, and the public to consciousness."
