Murder of Dilan Kortak: Investigation not conducted impartially 2022-12-03 14:46:53   İZMİR - Stating that 7 years have passed since Dilan Kortak's death and 2 years have passed since the Constitutional Court's violation decision, the investigation was carried out very slowly, Bülent Aşa said that the investigation was not conducted in an impartial manner.   In the case of Dilan Kortak (20), who was murdered by the police during the raid on her house in Sancaktepe, Istanbul on December 3, 2015, no effective investigation was carried out against the perpetrators despite 7 years. Upon a tip-off by the Istanbul Police Department, a search warrant was issued from the Istanbul Anatolian Chief Public Prosecutor's Office as part of the "delay in the case", and her house was raided by hundreds of police, supported by helicopters. Kortak was killed by 25 bullets that hit her body during this raid.   After Kortak's death, a confidentiality order was placed on the file regarding the criminal complaint made to the prosecutor's office. Then, the prosecutor's office decided that "there is no need to prosecute" 101 days after the incident. In the decision of the Istanbul Anatolian Chief Public Prosecutor's Office Officer Crimes Investigation Bureau on March 18, 2016, the reason was given that the police officers who carried out the operation acted "under the conditions of legitimate defense" and that the "authority to use a gun" regulated in Article 16 of the Police Duties and Powers Law, which was controversially passed by the parliament. . Following this decision, the confidentiality decision in the file was also lifted.   PROSECUTOR OFFICE DID NOT INVESTIGATION   In the examination of the file by the lawyers, it was revealed that there was no evidence of research on the file and that the basis of the investigation was the minutes prepared by the police. During the investigation, the prosecutor's office did not examine the weapons of the police officers who carried out an operation on the house where Kortak was staying, likewise, did not take the statements, hand swaps, fingerprints and footprints of the police, nor did it perform a luminal examination.   THE POLICY OF IMPUNITY   Evaluating the litigation process after the Constitutional Court decision and pointed out that they wanted to be left unpunished, the lawyer of the file, Bülent Aşa said: "2 years have passed since the Constitutional Court's decision of violation and 7 years since the death. The investigation was carried out very heavily. We see that the violations of the right to life, especially by the security forces, are either dropped due to the prescription or they are acquitted by applying the policy of impunity."   Aşa stated that they will attempt to conduct the investigation effectively by an independent body and to punish the suspects for "deliberate killing".
