The request for the dismissal of the case against Aydoğan was rejected. 2022-12-06 14:27:37   AMED - The request for the dismissal of the case against HDP former MP Nursel Aydoğan, whose immunity has been lifted by the ECtHR and whose trial has been violated, has been rejected.   While the trials are expected to be stopped due to the binding decision of the European Court of Human Rights (ECHR) regarding the lifting of immunity and the trial of 40 MPs of the Peoples' Democratic Party (HDP) on 20 May 2016, the trial of HDP MPs continues. The request for the stay of the trial of Nursel Aydoğan, who is among the 40 HDP MPs, whose immunity has been violated by the ECtHR, was rejected by the Diyarbakır 4th High Criminal Court.   Her lawyer Abdulkadir Güleç was present at the hearing, which Aydoğan, who was abroad, did not attend. Stating that they submitted the ECtHR decision to the court, lawyer Güleç stated that the legal basis for his client's trial disappeared with the ECtHR decision. Pointing out that the ECtHR decision is binding, Güleç demanded that the case against his client be dropped in line with the ECtHR decision.   At the hearing, where the prosecutor gave an opinion on the rejection of the request, the court also rejected the request for the dismissal of the case. The court adjourned the hearing to June 1 2023, deciding to continue the arrest warrant issued against Aydoğan.
